Terms of Service

1. Acceptance of Terms

By installing, accessing, or using Custom Product Designer ("the App", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

2. Description of Service

Custom Product Designer is a Shopify application that enables merchants to offer product customization to their customers. The App provides:

• A visual product designer for customer use on your storefront
• Product configuration and mapping tools
• Order management and print file generation
• Integration with your Shopify store and products

3. Account Requirements

To use the App, you must:

• Have an active Shopify store
• Grant the App the necessary permissions to function
• Provide accurate and complete information
• Maintain the security of your Shopify account

4. Subscription and Billing

The App may offer free and paid subscription plans. Billing terms:

• Subscription fees are billed through Shopify's billing system
• Usage-based charges (if applicable) are calculated and billed monthly
• You can cancel your subscription at any time
• Refunds are handled according to Shopify's refund policies

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purposes
• Upload or allow upload of illegal, harmful, or offensive content
• Attempt to reverse engineer, decompile, or hack the App
• Interfere with the App's operation or other users' access
• Use the App to infringe on intellectual property rights
• Resell or redistribute the App without permission

6. User Content

You and your customers retain ownership of designs and content created using the App. By using the App, you grant us a limited license to:

• Process and store designs for order fulfillment
• Generate print-ready files
• Display design previews within the App

You are responsible for ensuring that all content uploaded through your store complies with applicable laws and does not infringe on third-party rights.

7. Intellectual Property

The App, including its design, code, features, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the App or its components without our written permission.

8. Privacy and Data

Your use of the App is also governed by our Privacy Policy. We handle your data in accordance with applicable privacy laws including GDPR and CCPA.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

Either party may terminate this agreement at any time. You can uninstall the App from your Shopify admin. We may suspend or terminate your access if you violate these Terms. Upon termination:

• Your access to the App will be revoked
• Your data will be handled according to our Privacy Policy
• Outstanding charges will be due and payable

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiations. If unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
